Professional Experience

Patrick Howell is Board Certified in Construction Law by the Florida Bar, a recognition for having the highest standards of skill, specialty knowledge, proficiency, professionalism and ethics in construction law. Patrick has represented condominium and HOA clients throughout Central and Northeast Florida, obtaining substantial results for his clients in construction defect cases brought against developers, contractors, and subcontractors. He has also successfully argued appellate cases before the First, Second, and Fifth District Courts of Appeal. Patrick won the landmark case of Maronda Homes v. Lakeview Reserve before the Florida Supreme Court, which was a great win for all Florida homeowners associations.

As construction counsel for residential community associations, Patrick is able to handle a community’s construction defect claim from beginning to end, including:

  • Meeting with prospective clients to ascertain defect issues and dispense practical advice based on his years of experience in construction law;
  • Working with expert engineers and architects to prepare a report on defects;
  • Presenting the liable parties, including developers, contractors, and subcontractors, with a claim pursuant to Chapter 558,Florida Statutes;
  • Filing a lawsuit or arbitration claim; 
  • Finalizing the claim either at a settlement conference or at trial/arbitration;
  • Conferring with his client to identify how to best use the claims proceeds obtained; and
  • Drafting contracts for the repair of the association’s common areas or common elements. 

Speaking Engagements

Patrick is an active member of the Florida Bar’s Diversity and Inclusion Committee as well as the Orange County Bar’s Construction Law Committee. He is also a frequent lecturer on construction law, especially before community association property managers and board members:

  • On April 4, 2017, Patrick held a “Lunch & Learn” at the University of North Florida in Jacksonville for HOA board members and property managers and taught his one hour course “HOA Construction Defects 101.”
  • Patrick spoke to members of the Central Florida Chapter of the Community Association Institute at their annual Tradeshow in Orlando, and presented the course “Navigating the Litigation Quagmire.” During the one  hour course, property managers learned what they can expect if their association goes to court or arbitration over a claim, and what they need to do to preserve evidence and make a good witness when testifying on behalf of the associations they manage. Mr. Howell presented this course again May 19, 2017, to members of the Northeast Florida Community Association Institute at their 2017 Expo.
  • On February 23, 2017, Patrick presented his course “Condo Construction Defects 101” to property managers for FirstService Residential at their Altamonte Springs office. This one hour course for CEU credit provided the managers in attendance with information on the legal procedures involved with pursuing a construction defect claim on behalf of a condominium association.
  • On April 26, 2016, Patrick Howell spoke to condominium board members and property managers at the Northeast Florida Community Association Institute’s 2016 Expo. The one hour course, “Condominium Construction Projects Gone Wild!”, offered managers and board members an opportunity to learn about how to avoid pitfalls and successfully manage any size construction project at their condominium.

Recognition

Patrick has argued groundbreaking appellate cases before the First, Second, and Fifth District Courts of Appeal, as well as the Florida Supreme Court in the cases of Maronda Homes v. Lakeview Reserve HOA, Meritage Homes v. Lakes Roberts Landing HOA, Kings Ridge Community Ass’n, Inc. v. Sagamore Ins. Co., Airtran Airways v. AvAero Noise Reduction Joint Venture, Reserve at Wedgefield HOA v. Dixon, Lake Forest Master Comm. Ass’n, Inc. v. Orlando Lake Forrest Joint Venture, and Onionskin, Inc. v. DeCiccio.

Patrick has written numerous articles for the “Central Florida Times,” a monthly newsletter published by the Central Florida Chapter of the Community Association Institute, and for the “Community Connection,” the monthly newsletter published by the Northeast Florida Chapter of the Community Association Institute.
